Welcome to the website of Diehl Me In, LLC Fervi Nation (DBA) (hereinafter "We," "Us," "Our," or "Company"), operating at fervination.com (the "Site"). We thank You (any visitor to Our Site, hereinafter "You" or "Your") for visiting and considering Our products, services, and giveaways. By accessing the Site, creating an account, making a purchase, or entering a giveaway, You agree to the terms and conditions of this Agreement, which, along with the mutual promises made herein, forms a binding contract between You and Us. Please do not use this Site if You disagree with any part of this Agreement.
MOBILE TERMS OF SERVICE
The fervination.com mobile message service (the "Service") is operated by Diehl Me In, LLC. Your use of the Service constitutes your agreement to these terms ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice and may modify these Mobile Terms at any time; your continued use following any change constitutes acceptance.
By consenting to our SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Fervi Nation through your wireless provider, even if your number is registered on a state or federal Do Not Call list. Messages may include order updates, account alerts, giveaway entry confirmations, winner announcements, and promotional offers.
You understand that signing up for this program is not required to make a purchase or enter a giveaway, and consent is not a condition of purchase. Participation is voluntary.
We do not charge for the Service, but message and data rates from your wireless carrier may apply. Message frequency varies. You may opt out at any time by texting STOP, or by using the unsubscribe link where available. For support, text HELP or email jarod.diehl@fervi.us.
PRIVACY POLICY
Our Privacy Policy is located on our site and is incorporated into this Agreement by reference.
GIVEAWAY / SWEEPSTAKES TERMS
Fervi Nation operates product-linked giveaways as described on the Site (each, a "Giveaway"). Giveaways are governed by the Official Rules posted for each specific Giveaway, which are incorporated into this Agreement by reference. In the event of a conflict between this section and a Giveaway's Official Rules, the Official Rules control.
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. Void where prohibited. Open only to legal residents of the 50 United States and D.C. / specify, who are the age of majority in their state of residence. See the Official Rules for each Giveaway for eligibility, entry periods, odds, and alternate free methods of entry (AMOE).
Dual-Winner Mechanic. Each Fervi Nation Giveaway selects two recipients through separate methods:
- Chance-Based Winner — selected at random from all eligible entries received during the entry period, in accordance with the applicable Official Rules.
- Merit/Need-Based Recipient Act Of Random Kindness— selected by Fervi Nation in its sole discretion, based on criteria described in the applicable Official Rules or Giveaway promotional materials. This selection is not random and is not a game of chance; it reflects Fervi Nation's own charitable and brand-driven judgment.
Fervi Nation reserves full discretion over how the Merit/Need-Based Recipient is identified and selected for each Giveaway, and this process may vary from one Giveaway to the next.
Odds and Value. Odds of winning the Chance-Based prize depend on the number of eligible entries received. Approximate retail value of prizes will be disclosed in the applicable Official Rules.
Right to Modify or Cancel. We reserve the right to modify, suspend, or terminate any Giveaway, in whole or in part, if fraud, technical failures, or any other factor beyond Our reasonable control impairs the integrity of the Giveaway, subject to applicable law.
CHARITABLE / PHILANTHROPIC STATEMENT
Fervi Nation is a for-profit company, not a nonprofit organization or registered charity. From time to time, We may state that a portion of proceeds from certain products or promotions supports families in need, through direct assistance, partnership with third-party nonprofit organizations, or other means selected at Our sole discretion. Fervi Nation retains full discretion over the timing, amount, recipients, and method of any such contribution, and no specific dollar amount, percentage, or recipient is guaranteed unless expressly stated in writing for a specific promotion. Statements about charitable contributions do not create a fiduciary relationship, trust, or other legal obligation running to any customer, entrant, or third party beyond what is expressly stated for that specific promotion.
USER NAME AND PASSWORDS
You are responsible for all actions taken under Your account credentials and agree not to share Your log-in information with others. Keeping Your password secure is Your responsibility, and We are not liable for loss or damage arising from Your failure to do so. You agree to notify Us immediately of any unauthorized use of Your account.
PURCHASES
To make a purchase, select an item, choose applicable options, and add it to Your cart. Proceed to checkout to complete Your order. Orders may be subject to verification to prevent fraudulent transactions.
COPYRIGHT
All content on Our Site — including text, graphics, logos, images, and software — is the property of Fervi Nation and Diehl Me In LLC and is protected by U.S. copyright law. Reproduction, modification, distribution, or republication of Site content without Our express written permission is prohibited.
WARRANTIES
THE MATERIAL DISPLAYED ON THIS WEBSITE IS PROVIDED WITHOUT GUARANTEES, CONDITIONS, OR WARRANTIES AS TO ITS ACCURACY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS, CONTENT PROVIDERS, AND ADVERTISERS EXPRESSLY EXCLUDE ALL CONDITIONS, WARRANTIES, AND OTHER TERMS WHICH MIGHT OTHERWISE BE IMPLIED BY STATUTE, COMMON LAW, OR EQUITY, AND SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER — INCLUDING DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR INCIDENTAL DAMAGES — ARISING FROM USE OF, OR INABILITY TO USE, THIS WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS DOES NOT AFFECT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD, WHERE SUCH LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY (WHETHER FOR BREACH OF CONTRACT, TORT, OR ANY OTHER THEORY) SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
INDEMNIFICATION
You agree not to use information or services provided by Us in violation of any applicable law. You agree to indemnify, defend, and hold Us harmless — along with Our officers, directors, employees, and agents — from any claim, action, or damage (including reasonable attorneys' fees) arising from Your use of the Site, Your entry into any Giveaway, or Your violation of this Agreement.
FORCE MAJEURE
We are not liable for delays or nonperformance caused by strikes, fire, accidents, unavailability of materials, or any other cause beyond Our reasonable control.
ASSIGNMENT
You may not assign Your rights or obligations under this Agreement.
ENTIRE AGREEMENT
This Agreement, together with any Official Rules and Our Privacy Policy, constitutes the entire agreement between You and Us regarding the subject matter herein, unless modified by a signed writing.
DISPUTES
In the event of a dispute, You agree to first contact Us at jarod.diehl@fervi.us to attempt resolution before pursuing other action. This Agreement is governed by the laws of the State of Georgia, and the courts of Coweta County Georgia shall have exclusive jurisdiction over disputes arising from this Agreement. You waive any right to a jury trial in connection with such disputes.
SEVERABILITY
If any provision of this Agreement is held invalid by a court of competent jurisdiction, the remaining provisions remain in full force, and the parties agree to substitute a valid provision approximating the intent of the invalid one.
HEADINGS
Headings are for convenience only and do not affect interpretation of this Agreement.
AGREEMENT UPDATES
This Agreement is effective as of Sept 1, 2026. We reserve the right to revise it from time to time. Material changes will be communicated via email or a conspicuous notice on the Site
